PROPERTY DIVISION IN DIVORCE

One of the most difficult and complex areas of divorce is the division of marital assets and debts.

Marital property may include:

• Stocks, bonds

• Bank accounts

• Personal property

Debts (liabilities) include:

• Mortgages

Generally, any asset or liability acquired during the marriage is considered marital and subject to distribution. Some may be non-marital and awarded to one party only.

Florida statutes and case law provide for an “equitable distribution” of marital assets and liabilities—not necessarily equal, but fair.

Factors Considered Include:

• Contribution of each spouse to the marriage

• Duration of the marriage

• Economic circumstances of each spouse

The court will approve your agreement if it’s reasonable. If not, the court will divide the assets and liabilities during trial.
